摘要: 劳动合同的本质属性问题是一个有着重大意义的理论问题,若干年来劳动法理论界都把劳动合同的属性定位于“兼具人身关系和财产关系性质”,实际上劳动合同的本质属性在理论上还可以进一步深化定位为“就是身份合同”,同时这种身份合同具有特殊性。劳动合同的本质属性及其特殊性能够内生出订立履行劳动合同的五大基本原则,劳动合同的五大原则与统一《合同法》的五大原则没有实质性区别,但是劳动合同的公平原则应当强调注意保护劳动者权益。

Abstract: The legal attribute of labor contract is of great significance and has being defined theoretically as about “both personal relationships and the nature of property relations”.The author of the present essay holds that labor contracts in theory can be further deepened as a “status contract” which is of special nature.The legal attribute of labor contracts and its special nature give birth to the five fundamental principles for making and implementing labor contracts.Those principles are of no difference in nature from the five principles of Contract Law,except that more stresses should be placed on the protection of labor rights according to the principle of fairness.
