劳动争议之人民调解制度研究

摘要: 在《劳动争议调解仲裁法》实施三周年、《人民调解法》实施近一年之际,专门研究我国劳动争议的人民调解制度合时而有意义。目前我国劳动争议人民调解制度运转良好。劳动争议属于民间纠纷,法律上确立劳动争议人民调解制度是必要的。构建劳动争议人民调解制度时应当对各类人民调解组织同时并重,人民调解委员会委员产生方式应当充分体现群众自治性特征,人民调解组织与其他各种调解组织之间受理劳动争议不宜设置外部管辖划分,不同人民调解组织受理劳动争议原则上应有所区分、同时认可当事人的协商选择权。相关立法应当合理解决《人民调解法》与《劳动争议调解仲裁法》的法律冲突问题。

Abstract: At present, people’s mediation of labor disputes in China runs very well. Labor disputes belong to dispute among the people,so it is necessary to establish people’s mediation system of labor disputes. When establishing this system,equal attention should be paid to all kinds of people’s meditation organizations. Members of people’s mediation committee should be selected according to mass autonomy. In dealing with labor disputes,in principle,distinctions between different mediation organizations should be allowed and at the same time negotiation options of the disputing parties approved. The conflicts between People’s Meditation Law and Labor Dispute Mediation and Arbitration Law should be appropriately solved through legislation.
