Abstract: Demurrer to reference key to National Judicial Examination has been implemented for years and has exerted a positive effect on protecting examinees′ rights.However，the present demurrer system is not a legal procedure and neglect response to the demurrer.The authors think that the best way to solve the problems is to implement hearing in the demurrer，which will make the demurrer and response to it a legal procedure so that justice and openness can be ensured in the judicial examination and thus further improve the examination system and government credit.
