A COMPARATIVE STUDY OF CRIMINAL LEGISLATION ON MINERAL RESOURCES BETWEEN CHINA AND MALAYSIA

Abstract: Malaysian legal system has been greatly influenced by the common law of the U.K.In the meantime,it also values the creation of statute law.Although Malaysian criminal law has not covered legal regulation of the minerals,its mineral resources related laws,as accessories to criminal law,supplement and expand the range of its application,which reflects the present tendency of criminal legislation on mineral resources in nations concerned.The mineral criminal justice system created by Malaysia provides a good reference for China′s criminal legislation on mineral resources.On the other hand,the practice of the international legislation on accessory criminal laws has proved that the function of criminal law includes protection and guidance of socioeconomic development.When criminal law of our country is constantly being completed,criminal legislation in various special areas should also be paid attention to.
