On the Realization of Judicialization of Corporate Social Responsibility

Abstract:

Among many ways to promote the implementation of corporate social responsibility，judicialization is without doubt one of the most effective. Clear definition of the foundation of judicialization and the perfection of the procedural rules are the prerequisite to the judicialization of corporate social responsibility. Article 5 of the Company Law is not only a reflection of the complexity of corporate social responsibility，but also a manifestation of the adaptive character of the law. Based on Article 5，we can promote the judicialization of corporate social responsibility from the following four aspects，namely，clearly defining the foundation of judicialization，perfecting the procedure rules，constructing the mechanism of judicial proposals of the corporate social responsibility，and cultivating business literacy of judges.
