Reconstruction of Environmental Criminal Responsibility
—A Case Study of Three Recent Water Pollution Accidents in China

Abstract:

Section 6,Chapter 6 of Part 2 of Criminal Law of PRC provides legal guideline for punishment of crimes of undermining protection of environmental resources. However,the existing legislative system concerning environmental crime has displayed such defects as incomplete legislation,inadequate protection,unclear definition of constitutive elements of environmental crime and insufficient determination of criminal responsibility. Legislation concerning environmental crimes should provide legal guideline for both crime punishment and environmental protection so that the environmental criminal responsibilities accord with China’s economy and social situation.
