生态环境法典编纂视角下的碳普惠法律制度建构

摘要: 在编纂生态环境法典与实现“双碳”目标的时代背景下,碳普惠制度的发展呈现出本土资源禀赋、法律规范体系与绿色低碳转型的多重交织特征。生态环境法典编纂为碳普惠提供了制度嵌入的规范基础。路径依赖所形成的高碳发展惯性,促使制度设计需在排放控制、权责划分与市场监管中重构法律规则。为实现“双碳”目标,必须立足本土法律文化资源,使碳普惠制度在价值层面获得文化支撑,在制度层面形成国家、企业与公众协同参与的治理格局,并在器物层面依托数字化核算与绿色低碳技术形成可操作的落地方案,逐步构建中国式碳普惠制度,推动形成绿色低碳的生产方式和生活方式,促进中华传统法律文化、中国式现代化与绿色低碳转型的深度融合,为我国参与全球气候治理提供中国智慧和中国方案。

Abstract: Against the backdrop of the codification of the Ecological and Environmental Code and the pursuit of China's dual carbon goal, the evolution of the carbon inclusion policy reveals a complex interplay among local resource endowments, legal system, and the transition toward green and low-carbon development. The codification provides a normal foundation for embedding carbon-inclusion practices within a unified legal framework. The inertia associated with high-carbon development—shaped by historical path dependence—necessitates a reconstruction of legal rules governing emission control, allocation of rights and responsibilities, and market oversight. To realize the dual carbon goal, we must draw upon China's indigenous legal-cultural resources so that the carbon inclusion policy gains cultural support at the value level, forms a governance pattern with the cooperative participation of the state, enterprises and the public at the institutional level, and forms an operational landing plan relying on digital carbon accounting and green and low-carbon technologies at the instrument level. Through this multi-level integration, a distinctly Chinese model of carbon inclusion can be gradually formed, fostering green and low-carbon modes of production and living. This process deepens the convergence of traditional Chinese legal culture, China's approach to the modernization of the rule of law, and the national low-carbon transition, and ultimately contributing Chinese insights and solutions to global climate governance.
