Abstract: Data sharing between the police and the procuratorate is the premise and method enabling intelligent investigation supervision. The generative logic and legitimacy of data sharing between the police and the procuratorate to help intelligent investigation supervision is the result of the role of theoretical support, normative foundation, and efficiency demand. However, data sharing between the police and the prosecutors is at a low level currently, making it difficult to achieve complete and dynamic data sharing. This is mainly due to factors such as organizational trust in data sharing, challenges related to departmental interests, the inherent attributes of the data, and data security risks. Therefore, in order to promote the intelligent development of investigation supervision and maximize the positive effect of data sharing and empowerment, the principle of cooperation, the principle of confidentiality obligation and the principle of balance of interests should be adhered to at the value level, the construction of the system of data sharing should be promoted at the process level, and the dual cooperation of technology and system should be taken into account at the guarantee level.
