摘要:

消费者安全权是消费者权利保护中最重要、最根本的权利。针对近年来屡次发生的食品安全事故严重侵犯消费者安全权的情况,即将实施的《食品安全法》“重典治乱”,力图严惩食品违法生产经营行为。分析了《食品安全法》对我国消费者安全权保护机制的完善,主要体现在几个方面:从“监管体系”上加强消费者食品安全建设;建立食品安全监测与风险评估制度;统一食品安全标准;加强对食品添加剂的严格管理;强化食品生产经营者的社会责任与法律责任意识等。对加强政府部门对我国消费者食品安全的监管、增强消费者维护食品安全权益意识具有重要意义。

Abstract:

Safety right is the most important and fundamental consumer right which has been severely violated by the repeated occurrence of food safety incidents in recent years.This paper explains the perfection of food safety system by Food Safety Law,which is trying to punish the illegal acts in food production and distribution,holding that the following measures guarantee food safety: establishing regulatory food safety supervision and risk assessing system,introducing unified food safety standards,reinforcing restrictions on the use of food additives,enhancing the sense of social responsibility and legal duty of food producers and distributors.It is important to enhance government supervision over food safety,and consumers′ awareness of food safety.
