Abstract: Criminal law circle at home and abroad has put forward four criminal behavior theories: theory of spontaneous behavior，theory of social behavior，theory of purpose behavior and theory of personality behavior. The aforesaid four theories do have reasonable elements in them，but there are defects，too. Therefore it is necessary to improve criminal behavior theory based on human labor，which has uniform function. The improved criminal behavior theory，the theory of criminal behavior control，unifies the concept of behavior and covers crimes of omission and crimes of negligence，subsume circumstances both before and after crimes
