Abstract: It is common legislation practice in the majority of countries to adopt the system of void marriage. And this system was officially established in China after the amendment to the existing Marriage Law was enacted in 2001. However，the amendment fails to cover all the forms of void marriage in real life，and fails to discriminate the legal obligations between the party at fault and the nonfault party. Besides，the legal consequences of void and dissolved marriage are not clearly distinguished in the amendment，either. Therefore，the author holds that China’s void marriage system should be perfected by solving those problems.
