Research on the Incentive Function of Co-ownership of Patent Rights for Service Inventions and Creations

Abstract:  In the reform of rights empowerment for service scientific and technological achievements, joint ownership of patent rights
for service inventions and creations can generate a notable incentive effect on institutions and researchers. As the creators of service
inventions possess the intellectual capacity and willingness to commercialize and implement technological achievements, the incentive
effect of the joint patent ownership model can be fully realized. Joint ownership of patent rights for service inventions and creations
enables rational distribution of rights and interests in technological achievements between institutions and researchers, and reflects
researchers' direct participation in exercising relevant rights and gaining economic returns. To further maximize the incentive function
of this model, we need to broaden the scope of application for joint patent ownership. When determining co-ownership shares and
revenue distribution ratios, due consideration shall be given to each co-owner's technological contributions and cost inputs.
