论商业性言论及其保护

摘要: 商业性言论属于宪法言论自由的范畴,受宪法言论自由的保护,与政治性言论处于同等的法律地位。政府为了维护公共利益,可以对商业性言论采取管制措施。美国联邦最高法院在1980年的Central Hudson Gas & Electric Corp. v. Public Service Commission一案中所发展的四步骤分析法即:受保护的商业性言论须合法且非误导性、管制行为是为维护政府利益、管制措施与政府利益间存在直接因果关系、管制措施不超过必要的限度,值得我国商业性言论保护与管制的司法实践借鉴。

Abstract: In order to stimulate and encourage consumer spending,business operators may directly or indirectly introduce their products or services.Such words are commercial speeches.Commercial speeches are protected by the constitutional freedom of speech,and enjoy the same legal status with political opinions.For the sake of public interest,government can put a restriction on commercial speech.But according to fourpart analysis developed and applied by the Supreme Court of the United States in Central Hudson Gas & Electric Corp.v.Public Service Commission case in 1980,commercial speech can be protected by law only when it concerns lawful activity and not be misleading,and when the restriction serves and directly advances government interest and the restriction is not more extensive than is necessary to serve the interest.The fourstep analysis is of reference value to judicial practice concerning the protection and restriction of commercial speech in China.
