涉油气犯罪的生成机制及防控策略

摘要： 涉油气犯罪是近年来呈高发态势的犯罪类型之一，该类犯罪极大侵害和威胁了我国油气正常供应和社会稳定。涉油气犯罪以涉案后果的负外部性、涉案范围的广泛性、涉案人员具有组织性、犯罪类型相对确定性为其典型特征。这类犯罪近年来呈高发态势的主要原因在于：其一、目前我国社会结构转型时期尚存在着社会结构要素失衡等弊端；其二、目前存在着社会规制措施缺位及管理机制失调的现实。要有效防控涉油气犯罪，必须做到深化体制改革、理顺社会结构，完善立法并严格执法。

Abstract: Crimes in oil and gas sector is becoming increasingly serious in recent years，which seriously infringe on the regular supply of oil and gas and threat social stability.Crimes in oil and gas sector are characterized by the external diseconomy of their consequences，wideness of crime coverage，organized members and relatively fixed types of crime activities.The increase of crimes in oil and gas sector is mainly caused by imbalanced social structure.Another reason for such crimes is the absence of social regulation and maladjustment of management mechanism.To prevent crimes in oil and gas sector，efforts should be made first to deepen social reform so as to establish a more reasonable social system and to further complete relevant laws for more severe punishment against crimes in oil and gas sector.
