矿区生态修复的行为责任与状态责任之辩——以《矿产资源法》第三次修订为契机

Behavior Liability and State Liability for Ecological Restoration in the Abandoned Mining Area——A Discussion the Third Revision of the Mineral Resources Law

摘要: 行为责任在因应矿区生态环境损害时,由于因果关系复杂等结构性缺陷而难以及时确定责任主体,致使矿区生态修复长期处于停滞状态,甚至出现大量废弃矿山无人修复,造成资源的严重浪费和生态利益的重大损失。状态责任可较为有效地弥补行为责任之不足,由事实管领人承担责任可及时启动矿区生态修复,进而恢复矿区资源的重新利用。《矿产资源法》的修订在确认修复责任时,应以矿区生态修复及时有效为原则,同时合理分配矿区生态损害成本。原因行为、物之管领、公共信托与公益保护生成矿区生态环境保护义务,《矿产资源法》应当确立矿区生态修复多元主体担责机制:矿业权人承担首位修复的状态责任、实际损害行为人承担终局赔偿的行为责任、政府承担综合环境治理的公法责任,同时鼓励第三方主动参与废弃矿山生态修复。

Abstract: The structural defects like complexity of causality in behavioral liability makes it difficult to timely determine the subject of liability in response to the ecological environment damage in the mining area. As a result, the ecological restoration of the mining area is in a state of stagnation for a long time. The state liability can effectively make up for the deficiency of the behavior liability, and the person in actual charge of the work can start the ecological restoration in time to restore the reuse of the mining resources. In the revision of the Mineral Resources Law,the liability for the ecological restoration in the mining area should be confirmed to ensure timely and effective restoration, and to ensure reasonable allocation of the ecological damage cost of the mining area. Cause behavior, management of property, public trust and non-profit protection comprise ecological environment protection obligations in the abandoned mining areas. The Mineral Resources Law should establish a multiparty liability mechanism for ecological restoration of mining areas with mining rights holders bearing the first state liability for restoration,perpetrators taking behavioral liability for the final compensation and the government assuming public law liability for comprehensive environmental governance. At the same time, the third parties should be encouraged to participate in the ecological restoration of abandoned mines.
