Regulation Dilemma and Institutional Response of Digital Platform Link Blocking Behavior

Abstract: In the era of digital economy,the continuous presence of unreasonable link blocking not only hinders users' right to freedom of communication,but also excludes other operators,damaging the free and fair market competition mechanism,and it is necessary to take anti-monopoly measures against such behaviors. At present,the anti-monopoly legal regulation of link blocking has practical difficulties such as uncertainly defined scope of “related commodity market”,difficulty in identifying “market dominant position”,doubt in identifying damage and consequences of “difficulty in conducting transactions”,and vague standard of liability identification. In order to establish the regulation system of digital platform link blocking behaviors,we should start with system construction,law enforcement improvement,industry self-discipline and user supervision,and standardize the platform market behavior and help smooth market operation by adding “super platform” clauses,strengthening platform neutral obligations,improving supervision before and after the event,and strengthening social supervision.
