论跨国公司在全球数据治理中的法律地位

摘要: 全球数据治理已成为当下全球治理的重要议题,跨国数字平台逐渐成为经济全球化主角。根据全球数据治理的含义,可以从其主要参与方和内容两个角度对其进行分类。随着数据相关问题在全球范围内受到前所未有的关注,跨国公司参与全球数据治理成为了时代需要。跨国公司对全球数字经济发展和数据治理的现实影响主要体现在:数字经济快速发展离不开跨国公司的贡献,跨国公司在诸多行业实践中对全球数据治理产生深远影响。跨国公司通过全球性或区域性多边条约中的数据治理条款来具体发挥作用。跨国公司已然成为全球数据治理的重要法律主体,故应将跨国公司纳入全球数据治理法律规制中,并构建其参与全球数据治理的监督和追责机制。

Abstract:

Global data governance has become an important issue in current global governance and transnational digital platforms have gradually become the protagonists of economic globalization. According to the meaning of global data governance, it can be classified from the perspectives of its main participants and content. With the unprecedented attention to data-related issues on a global scale, the participation of transnational companies in global data governance has become the needs of the times. The practical impact of transnational companies on the development of the global digital economy and data governance is mainly reflected in the rapid development of the digital economy and the profound impact on global data governance in many industry practices related to transnational companies. Transnational corporations play a concrete role through data governance provisions in global or regional multilateral treaties. And these have become important legal subjects of global data governance, so transnational corporations should be included in the legal regulation of global data governance, and a supervision and accountability mechanism for their participation in global data governance should be established.
