A Restatement of Consumer Rights and Interests: Reflection on the Choice of Payment Method

Abstract: The era of digital economy based on "Internet" and "digits" has changed the way of cash payment and card-based payment in traditional consumer payment. Mobile payment has infiltrated and occupied the trading market because of its convenience and security, which in turn triggered a cash rejection phenomenon. The freedom in the choice of payment methods is also in trouble:payment is essentially different from goods and services, so that the Consumer Protection Law cannot provide appropriate legal protection. The freedom in the choice of payment methods requires that the law must be clear when the payment method is open, and the operator is required to explicitly state that the consumer has the obligation in choosing the way of payment, thus effectively safeguarding the legitimate rights and interests of consumers.
