重庆市假冒专利行政执法的绩效研究

摘要/Abstract

摘要： 假冒专利行政执法在保护知识产权方面起着重要的作用。检索国家知识产权局和重庆市知识产权局发布的重庆市2015-2018年假冒专利行政执法的相关数据信息，分析重庆市2015-2018年假冒专利行政执法的结案数、涉案专利类型、案卷类型、被查处人类型和技术领域构成五项内容，结果表明：重庆市假冒专利行政执法的结案数在西部地区位于下游水平，涉案专利类型中占比最高的为外观设计，案卷类型中占比最高的为销售假冒产品，被查处人类型主要集中在企业，技术领域高发区集中在日常生活用品类。进一步提高重庆市假冒专利行政执法的绩效，可以为将重庆市打造成西部大开发的重要战略支点、“一带一路”和长江经济带的联接点奠定坚实的基础。

Abstract: Administrative enforcement in counterfeit patents cases plays an important role in protecting intellectual property rights. Analyzing the data of administrative enforcement in counterfeit patent cases can further improve the performance of administrative enforcement. We retrieved the data of counterfeit patent cases in Chongqing by SIPO and CQIPO,and analyzed the number of closed cases, the types of patents involved, types of case files, the type of people being investigated and the technical fields. The results show that the number of closed cases in Chongqing is at the bottom in West China;cases concerning industrial design patent accounted for the largest proportion in the types of patents involved;the type of case files with the highest proportion is counterfeit products selling;the type of people being investigated are mainly from enterprises;the high incidences in the technical field is in the category of daily necessity.
