摘要：

以《城市拆迁条例》为背景，从法经济学的角度分析了目前城市拆迁的体制存在的使政府公权力的公信力降低、引发第三种诉愿、巨大的利益空间易于滋生腐败、效率低下等弊端。认为：实施政府和人民共同主导型的拆迁制度是根除各种弊端的较好选择，在拆迁制度的安排中，应区分公益性拆迁与商业性拆迁，严格限定公益性拆迁的含义，防止将商业性拆迁项目归于公益性项目。

Abstract:

From the perspective of economics of law，this paper studies the problems in the present city demolition system which is low in efficiency and weaken the credibility of government public power and thus generate new appeals.Besides，the great profits tend to breed corruption.The authors，therefore，hold a city demolition system led by both the government and the citizens involved will help to solve those problems.They also point out that demolition projects for public welfare and those for commercial purposes should be clearly defined and carried out in different ways so as to prevent demolition projects for commercial purposes from operating in the name of public welfare.
