Abstract: Provisions on Several issues Concerning the Examination and Judgment of Evidence in Handling Death Penalty Cases，jointly issued by the Supreme People’s court and other five ministries，took effect in July， 2010. Due to the special nature of death penalty cases，the Provisions has established a stricter standard for the examination and judgment of evidence concerning death penalty cases than ordinary criminal cases. The death penalty cases here refer to cases with the final sentence of immediate execution. The standard is not only the standard for criminal conviction but also the standard for measurement of penalty. The standard set by the Provision has been established and its application will not reduce the quality in handling ordinary criminal cases.
