Abstract:

Criminal responsibility is a basic concept in criminal law，and its foundation is of significant theoretical value. There
once were three theories about the foundation of criminal responsibility，which were contradicting，imbalanced or unconvincing.
At national level，protecting the basic social interest and all members’basic rights of the society is the first dimension of its
foundation. The second dimension of the foundation can be seen in the threat of criminal behavior. And the third dimension of
the foundation is the negative attitude of the conductor which brings harm and damage. According to the above analysis，the
foundation of criminal responsibility can be integrated into fault liability.
