THE IMPACT OF TAIWAN′S “CONSTITUTIONAL REFORM” ON “ONE CHINA” PRINCIPLE

Abstract: The characteristics of “Constitutional Reform” in Taiwan include having established the so-called “Centralized Presidential System” but gradually deviated from “One China” principle. Although undergoing seven constitutional amendments,“One China” principle still dominates the framework of Taiwan′s “Constitutional Order”,which upholds the hope and basis of national reunification. From the very beginning of Taiwan′s democratization,there exists “Constitutional Dilemma”,which can be concluded as follows. First,it is illegal for Taiwanese to amend the “constitution of Republic of China” before Chinese reunification. And no solution to the dilemma can be found if they continue to adhere to the so-called “Taiwan is a sovereign state” instead of “One China” principle. Furthermore,“the referendum for introducing constitutional amendment”,passed by the 7th “constitutional amendment” in 2005,provides the possibility to abandon thoroughly “One China” principle by “Taiwan Independence Power”,and thus Taiwan may be led astray.
