摘要/Abstract

摘要： 当前，国内农民工维权活动经常遭遇“举证难”的困境，且建立农民工档案已被许多地方规定为用工单位的义务，因此在涉及农民工权益的诉讼或仲裁时，应采取“举证责任倒置”规则，农民工只需要提供基础证据，而由用工单位承担提供农民工档案等证据的举证责任，以此维护农民工的合法权益。

Abstract: Off farm workers in China often confront difficulties in offering proofs when protecting their legal rights while it is employers′ obligation to establish archives for the off farm workers according to regulations.The author hereby suggests that the principle of reversed onus probandi should be adopted so that off farm workers have better opportunity to protect their legal rights by just providing the basic evidence.
