我国企业劳动争议调解委员会制度的现时思考

摘要: 在《劳动争议调解仲裁法》实施两周年以后,考量我国“两方代表”组成的企业劳动争议调解委员会制度合时而有意义。现行“两方代表”组成的企业劳动争议调解委员会制度虽有值得肯定的地方,但它却存在着企业劳动争议调解委员会缺乏独立性与公正性、难以成为真正的组织体、由企业承担其活动经费而又没有不承担的不利后果等制度性缺陷,而且实施效果越来越差。我国企业劳动争议调解委员会制度应当考虑废除。

Abstract: After the Law on Labor Dispute Mediation and Arbitration of the People′s Republic of China has been enforced for two years,it is timely and meaningful to inspect China′s system of enterprise labor dispute mediation committee composed of “representatives from two parties”.Although the present system of enterprise labor dispute mediation committee has its positive sides,it has inherent institutional deficiencies as it is financially dependent on the enterprise and its enforcement effectiveness is getting worse.Based on the above analysis,the author suggests that enterprise labor dispute mediation committee system should be abolished.
