Abstract: Organized crimes seriously erode social stability. The special crackdown against organized crimes under the new situation aims to eliminate and prevent organized crimes. The public security organs, as the main force of the special national anti-crime and anti-evil efforts, have made outstanding contributions to the achievements. But there still exist problems in their work, such as an unclear or inaccurate understanding of the legal requirements for the rule of law in the crackdown and the problems take on different forms in practice: inadequate understanding of the principle of rule of law in handling cases, inconsistency in applying the measure of legal punishment, inaccurate application of the policy of“ tempering justice with mercy”, incorrect understanding of the requirements of achieving“ political, legal and social effects” . Therefor we suggest adhering to the principle of modesty in applying criminal law, correctly grasping the relationship between“ handling cases according to law” and“ applying severe punishment according to law”, and between“ applying severe punishment according to law” and“ tempering justice with mercy”, hoping to provide some reference for the public security organs to perform more effectively and achieve political, legal and social effects in the special crackdown against organized crimes.
