"Offspring with urban household
registration can inherit the right to use rural homestead" is a major
breakthrough in jurisprudence, but in practice, there are problems including increasing"hollow houses", vague policies on housing transfer
and inheritance, unclear
criteria of the degree of repair after housing inheritance, contradictions between "one
house with multiple inheritances" and rural production priority, mismatch between the rural housing
market price and the actual value, and disconnection between related policies and laws. In this
context, this paper
aims at solving the current problems based on the local conditions and
circumstances, by firstly
specifying the time limit for inheritance of the right to use homestead and the
standard of house repair degree, then moderately releasing the right of rural residential property
transaction and innovate the inheritance mode of homestead use right, and finally putting forward
targeted countermeasures and suggestions to achieve the coordination between
policies and laws.
