The Perfection of Local Legislation against Unfair Competition in China

Abstract: The local legislation of anti-unfair competition formulated in the 1990s failed to keep pace with the present development of market economy as it falls behind in the definition of the basic function,regulations on market behaviors and the setting of liability terms. Local legislation against unfair competition in China must be perfected aiming to "protect competition, restrict the market,and to promote market efficiency" so as to maintain its professionalism,independence and its legal protection of multi-rights. The function of local legislation in "furthering the regulations of the upper-level law with local features" should be exerted to optimized the terms of conduct and liability clauses,so that local legislation against unfair competition can achieve its proper goal.
