A Study on Restorative Justice on Carbon Emission Peak and Carbon Neutrality

Abstract: The development goals of carbon peaking and carbon neutrality conform to the inherent requirements of China's sustainable development and demonstrate China's determination for green and low-carbon development. At present, environmental crimes seriously damage the ecological environment of forests and grasslands, and become a major obstacle to achieving the goal of carbon peaking and carbon neutralization. Restorative justice conforms to the requirements of carbon peaking and carbon neutralization, and is in line with the protection of ecological and environmental legal interests. Applying restorative justice to environmental crimes can not only punish criminals who destroy the environment, but also maintain ecological balance and environmental security, and promote the realization of carbon peaking and carbon neutralization. At present, measures such as perfecting legislation, improving professionalism, broadening the scope of application, improving effective supervision \mbox{ability, } and establishing a sound coordination and linkage mechanism should be taken to better apply restorative justice to carbon emission reduction cases so as to promote the realization of the goals of carbon peaking and carbon neutralization in China.
