Design of Interruptible Energy Contract in the Context of Asymmetric Information

Focusing on energy supply tensions, we establish models for the design of interruptible energy contract under three information structures. The impacts of relevant factors on the optimal interruptible contract and peak shaving input level and benefits of the supplier are studied. Contract distortion, information rent and information value are discussed. The results indicate that the interruptible contract can motivate industrial users to participate in energy peak shaving, and the supplier prefers to choose industrial users with stronger interruption capabilities and higher peak shaving efficiency and externality. Asymmetric information will not only cause industrial users to reduce peak shaving input level, but also distort optimal interruptible contract. Industrial users can only obtain information rent from interruption capability. When peak shaving efficiency of industrial users is high and the externality of peak shaving auxiliary service reaches a certain threshold, the supplier can obtain higher information value by collecting industrial users' private information related to interruption capability.

Urban parking has become a problem restricting urban governance, the solution of which is to commercializing urban parking. Commercialization of urban parking should be done through supply side reform of urban parking with definition of the role of government, market and society. The increase of parking supply can be realized through government mechanism or the market mechanism. But it is necessary to ensure market mechanism plays an active role in resource allocation in promoting market supply of parking resources. Commercialization of professional parking resources needs a good investment environment to encourage private capitals. It is necessary to formulate a reasonable price system conducive to the allocation of parking resources in time and space with return of investment and operating profits of private capitals as the incentive mechanism.

Since the 18th National Congress of the CPC, China has made historic achievements in Party construction and clean government, but grassroots corruption has not been completely eradicated, and the reform of grassroots corruption governance model is urgent. The big data technology is driving great changes in the governance structure and governance capacity of the country and grassroots society. "Internet + supervision" is a successful combination of technology and governance and tackles the major problems in corruption governance at grassroot level and helps avoid governance risks due to information asymmetry, inadequate governance at grassroot level, and interference of the acquaintance society. With technological support of the "Internet + supervision" model, the grassroot government has can empower people "direct supervision" and implement the practice of "transparent administration". This process is not only the shaping of the organization by technology, but also the absorption of technology by the organization, and more importantly, the recognition and support of the people to the organization. The efficient interaction among the three factors jointly promotes the reform of corruption governance at grassroot level.

Since the 18th National Congress of the Communist Party of China, the research results of domestic academic circles on the ideological leadership have become increasingly abundant. By sorting out the main research trends in the academic world, we found that scholars have conducted extensive researches on the origin and basic connotation of the concept of ideological leadership, on why ideological leadership is necessary, on the difficulties it faces, and on the practical paths. These studies, problem and practice orientated, have made certain theoretical contributions to follow-up researches. However, in the study of ideological leadership, the academic community still needs to further clarify related concepts and theoretical origins, to strengthen empirical researches on the basis of theoretical concerns, to expand international perspectives on the basis of analyzing the basic experience gained in China, and to take international perspectives in researches on China, and to do researches beyond existing disciplines so as to lay a more solid foundation for consolidating ideological leadership.

Time as a philosophical category has long been concerned by people. Marx understood time from practice and regarded it as human's active existence, development space and life scale. On this basis, we analyze and reveal the exploitative nature of the capitalist mode of production on time. In the context of today's digital capitalist relations of production, there is a new alienation of human active existence, blurring the line between labor and leisure. The development space of human is further compressed, and the one-sided emphasis on the current consumption concept dissipates the scale of life, which reflects that the time exploitation of digital capitalism is further aggravated. Article 1217 of Civil Code clarifies that the liability for damage in free riding as the liability for motor vehicle traffic accidents. According to this, offering free riding is of the nature of a tort, rather than just good intentions to transport others free of charge. The rule of reducing driver's liability for damage in free riding traffic accidents originated from foreign legislation, but has been abolished with the popularity of motor vehicles, the development of liability insurance and the strengthened protection of the rights and interests of the injured person. The legislative purpose of the Article 1217 is to encourage people to help each other, but it ignores the change of legal environment outside China. The basic requirements of corrective justice have not been met in terms of protecting of the injured person, and the core socialist values are not upheld entirely. The legitimacy of Article 1217 should be strengthened by limiting its application in the field of compensation for mental damage, and a corresponding insurance and social security system should be established.

The Civil Code establish the significance of the mode of "joint signing of community debt", but scholars disagree about its legitimacy and applicability. Theoretically, the dispute over the legal norms of "joint signing of community debt" by both spouses in China stems from the positive and negative views on the moral, economic and necessity aspects. In judicial practice, there exists an imbalance between litigation rights and substantive rights in norms of "joint signing of community debt" by both spouses. Therefore, the "purposive intervention mode" in which the state selectively intervenes in the internal behavior of the family has legitimacy in the activity of optimizing the normative function of the "joint signing of community debts" by both spouses. On the one hand, the "purposive intervention mode" requires that the optimization activities be guided by "consequentialism";on the other hand, it requires progressive promotion in tackling the morality bottom line, failure of family adjustment function, and dissolution of the marital community and awakening of awareness of individual rights.

According to Article 1240 of the Civil Code, if it can be proven that the damage is intentionally caused by the victim or the victim is grossly negligent for the occurrence of the damage in a high-voltage electric shock infringement case, the liability of the operator of the high-voltage electric facility may be exempted or mitigated. Among the reasons for exempting high-voltage facility operators from the liability, the victim's intention includes direct intentional and indirect intentional. But in practice, there are no uniformed criteria for victim intention identification, or for determining whether the victim constitutes an intention, or for identifying the boundary between the victim's intention and negligence. We hold that victim intention cannot be determined only on ground that the victim has committed an illegal act. The degree of victim fault should only be judged according to the level of the breach of duty of care within the scope of the victim's fault unless there are special reasons. The victim's premeditated self-injury or suicide, ignoring obvious warnings and others' dissuasion should be considered victim intention.

Replacing high-carbon fossil energy with zero-carbon and low-carbon renewable energy is the most important way to achieve carbon neutrality. Energy substitution needs legal system as the external guarantee，and marketization is the ultimate destination of renewable energy. And guaranteed acquisition and competition are typical measures of policy and marketization. Energy substitution path based on this background is facing difficulties such as alienation of system practice，vague administrative functions，unbalanced promotion mechanism，conflict between acquisition and competition rules，disorderly competition， etc.， which cannot meet the needs of high-quality development of renewable energy. In order to alleviate these difficulties and promote the high-quality development of renewable energy， it is necessary to further interpret the legitimacy of compulsory obligations. At the same time， the system design should， under the guidance of the principle of efficiency， clarify government functions， balance guarantee and competition， and effectively link up with the consumer-side consumption guarantee mechanism and the consumer-oriented incentive mechanism to jointly promote the substitution process of renewable energy.

Tertiary distribution is an important benchmark in the process of modernization of national and social governance. A correct understanding and scientific measuring of fairness and rationality of the compensation is a key issue that enterprise management needs to solve. This paper defines equity tolerance as the maximum of the pay gap that employees can accept. Through questionnaire survey and panel data of listed companies，we find out that industry characteristics，regions，job levels and other work environment factors have an impact on equity tolerance，and we confirm the critical point of the positive effect that equity tolerance exerts on enterprise performance. The critical value of equity tolerance of the pay gap between employees and department leaders is 57.17，and the critical value of fair tolerance between employees and top leaders is 305.12. Below this threshold，equity tolerance plays a significant positive role in promoting job performance；otherwise，it will play a significant negative role. The threshold value of equity tolerance of the pay gap of listed companies is 454.69. When it is lower than this critical value，equity tolerance has a positive effect on business income and a negative impact on operating income otherwise.

When the COVID-19 swept through Wuhan，the mobile cabin hospitals were like “life-saving arks”for many patients with minor illnesses. However，as the patients were in a state of panic and were unfamiliar with each other，the hospitals were in disorder at the beginning. Through the study of the network ethnography of Wuchang mobile cabin hospital，we found that the hospital completed the process of internal integration and order generation through a series of initiatives，such as building relationships of trust，creating collective identity，constructing community networks，and forming group norms. The process of internal integration of the hospital was the process of forming a micro-anti-risk community. The mobile cabin hospital community，characteristic of spatial aggregation，relational reciprocity，emotional identity and functional coordination，in turn，contributes to maintain order and function of the mobile cabin hospital，which brings theoretical enlightenment to the emergency management and risk prevention and control in the normalized epidemic prevention and control.

In the post-information society，the minors’ right to be forgotten，a new digital right different from the traditional right to be forgotten，highlights protection specific to the minors and plays an indispensable role in the protection of the minors' personal data information. In jurisprudence，the right to be forgotten of the minors and freedom of speech and privacy are the pursuit of the same value，and must be given special legal protection. The abstract protection model of the minor's right to be forgotten under the framework of the GDPR of the European Union and the Special Protection Model of the minor's right to be forgotten in the COPPA，DNTKA and California Act No. 568 of the United States have their own emphases，but related legislation stipulation is scattered in China. In this regard，we can analyze the relevant legislative experiences of the EU and the US，starting with the general principles，the scope of the subject，the content of rights and duties，and the boundary of the exercise of rights，etc. to localize and transplant the part suitable for China's legal soil，and make legislation of data rights protection of minors with Chinese characteristics.

In labor relations，regulating the rights of employers and strengthening the protection of workers' personal information are important measures to protect the rights and interests of workers and balance the interests of employers and the legitimate rights and interests of workers in the era of algorithms. To realize the balance of employers and workers' personal information rights and interests，the principle of proportion is of great significance to fill the loopholes in the law and perfect the protection mechanism of workers' information rights and interests. In the algorithm age，personal information protection is faced with corporate algorithm technical violations，barriers to the implementation of “informed consent”，conflict between corporate information management right and employer rights，etc. To protect the personal information rights of employers，the principle of proportion should be followed in management and regulation of corporations，and principles of legitimacy，appropriateness，and of necessity are applicable. The balanced development of corporate interests and rights and employers’ rights and interests of personal information can be realized by establishing the pre-examination provisions of corporate algorithm technology，improving the rules of “informed consent” of employers’ personal information，and by improving the mechanism of employer personal information protection.

In the era of digital economy，the continuous presence of unreasonable link blocking not only hinders users' right to freedom of communication，but also excludes other operators，damaging the free and fair market competition mechanism，and it is necessary to take anti-monopoly measures against such behaviors. At present，the anti-monopoly legal regulation of link blocking has practical difficulties such as uncertainly defined scope of “related commodity market”，difficulty in identifying “market dominant position”，doubt in identifying damage and consequences of “difficulty in conducting transactions”，and vague standard of liability identification. In order to establish the regulation system of digital platform link blocking behaviors，we should start with system construction，law enforcement improvement，industry self-discipline and user supervision，and standardize the platform market behavior and help smooth market operation by adding “super platform” clauses，strengthening platform neutral obligations，improving supervision before and after the event，and strengthening social supervision.

Universities，the bastion of innovation and entrepreneurship education in China，play an important role in cultivating the innovation and entrepreneurship of contemporary college students，and in promoting the implementation of China's innovation-driven strategy through an active response to the call of “mass entrepreneurship and innovation”. However，there are many deficiencies in training the innovation and entrepreneurship of college students in provincial universities，such as students’ insufficient motivation for innovation and entrepreneurship，fragmentation of student creativity，lack of in-depth cooperation between industry，university and research，and difficulties in transforming research achievements. Based on the knowledge sharing platform，this paper proposes a path to cultivate such ability of college students majoring in economics and management in provincial universities，constructs a trinity knowledge sharing platform of “interdisciplinary integration platform”，“innovation and entrepreneurship competition guidance platform” and “industry-university research collaborative innovation platform” to fully improve innovation and entrepreneurship of college students. It provides a reference for other provincial universities to improve students' innovation and entrepreneurship ability.

Cross-cultural generation of China image plays an important role in strengthening cultural dialogue and communication between China and foreign countries and telling Chinese stories to the world. The development of Chinese comparative literature has been accompanied by self-reflection of disciplinary discourse. Since the 1920s，many Chinese scholars have described and explained the China image generated in the cultural exchange between China and the West from the relationship between China image and Western historical，social and cultural context. The cultural space in the context of mutual learning of civilizations triggers and awakens modern Chinese scholars’ consciousness as national cultural subjects，prompting them to reflect on traditional academics，broaden their comparative horizons and attach importance to the imaginative construction of others in texts. The industrial scale shale gas development plays an important role in enhancing China’s energy security and improving the energy structure. However， non-technology factors such as local government behavior， social surroundings， enterprise management， cooperation mechanism and policies and regulations are restricting shale gas development in China. It is urgent to understand the mechanism of impact of non-technology factors on the sustainable development of shale gas. A dual principalagent model consisting of the central government， local government and shale gas enterprises is used to study the characteristics of impact of non-technology factors on the sustainable development of shale gas. Through numerical simulation of the findings， we come to the conclusion that the more standardized the management system， the higher the proportion of enterprise revenue commission and the central government revenue， that the increase in public service efficiency can motivate local governments to increase development support and thus obtain higher commission ratios and more profits. The government departments’ encouragement to enterprises to improve their management system， to promote government enterprise cooperation， and to improve the efficiency of public services， will help to improve the industrial scale production of shale gas and the benefits of all stakeholders.

Systematically combing， analyzing and evaluating research results in the field of environmental regulation can reveal the development and evolution of researches in this field， and provide reference for further research. CSSCI journal papers in CNKI are selected as research data， and Citesapce is used to analyze the scientific knowledge map of environmental regulation researches. We conclude that since the beginning of the new century， with the reform and opening-up and the promotion of environmental governance practice， the academic community has paid more attention to environmental regulation， showing an upward and rapid growth in general， which is mainly divided into two stages: transformation and upgrading stage and continuous deepening stage. However， the network of research cooperation is not strong enough， which restricts the indepth development of researches. We suggest that more attention be paid to environmental governance issues such as “human settlement environment” and “ecosystem quality” in the practice of rural revitalization， and focus on collaborative researches on environmental regulation and digital economy， digital finance， finance， taxation and financial policies.

The provisions of supplementary liability in China’s civil and commercial laws are scattered. There is no uniform rule on the protection of the sequential interests of supplementary liability， and there are inconsistent operating standards in judicial practice. Execution in sequence and benefit of discussion provide different degrees of protection for the interests of the sequential of the parties， and China’s Civil Code is characteristic of both. An analysis of all kinds of supplementary liability from the two dimensions of substantive and procedure reveals that the necessity of the protecting of sequential interests is different. Therefore， after admitting supplementary partners can reduce liability claims according to Article 698 of the Civil Code， the application of Article 687 should be determined according to the necessity of the protection of sequential interests. In addition， the benefit of discussion may be presented prior to the termination of execution， and the sequence of execution shall be determined prior to the commencement of the execution program， but may be changed during execution.

At present， the procuratorial organ will confront obstacles when applying the powerful weapon of punitive compensation in the public welfare litigation in the field of food safety due to the lack of the normative element of “the procuratorial organ has the right to claim no less than that of the social public welfare organization”， and there is also a unclear theoretical definition and distinction of the functions of “punishment” and “compensation”. In order to give full play to the function of punitive damages， we should adhere to the separation of the “compensation” function and the “punishment” function in the future public interest litigation legislation， and give the procuratorial organ the right to request punitive damages based on the “punishment” function， and design reasonable specific systems for the procuratorial organ to institute punitive damages for public interest litigation.
