Legal System Response to Environmental Risk of Shale Gas Development

Abstract: The legal regulation of environmental risk of shale gas development aims to solve the environmental risk in the process of shale gas development, to promote the coordination between shale gas development and environmental protection, and to realize the sustainable development. At present, at both the national or local level in China, there are legislative loopholes, which can only be regulated by the relevant provisions of the environmental protection law and the mineral resources law. But this cannot effectively solve the environmental problems in shale gas development. Britain and the United States have some advanced experience and mature systems in the legal regulation of environmental risk of shale gas development. We can draw lessons from the foreign experiences to perfect the legal regulation of shale gas environmental risk and realize the unification of economic, social and environmental benefits of shale gas development.
